1. Nature of Services

Bombazi Safaris arranges and facilitates guided hunting safaris and related travel experiences in Southern Africa.

We work in partnership with licensed professional hunters, landowners, lodges, firearm permit facilitators, and other third-party service providers.

Bombazi Safaris does not operate as a common carrier, insurer, or guarantor of third-party services.

2. Assumption of Risk

Safari hunting involves inherent and significant risks, including but not limited to:

• Firearm use

• Dangerous and unpredictable wildlife

• Remote terrain

• Extreme weather conditions

• Travel delays or disruptions

• Limited access to medical facilities

By booking a safari, you voluntarily assume all risks associated with participation.

You acknowledge that injury, illness, property damage, or death may occur.

3. Release & Limitation of Liability

To the fullest extent permitted by law:

Bombazi Safaris, its owners, directors, officers, agents, affiliates, partners, and contractors shall not be liable for:

• Personal injury

• Death

• Property damage

• Loss of trophies

• Travel disruptions

• Airline delays

• Permit denials

• Governmental restrictions

• Force majeure events

Liability, if any, shall be strictly limited to the amount paid directly to Bombazi Safaris for services rendered.

Under no circumstances shall Bombazi Safaris be liable for indirect, consequential, incidental, or punitive damages.

4. Third-Party Providers

Bombazi Safaris contracts with independent third parties, including:

• Professional hunters

• Lodges

• Airlines

• Firearm permit services

• Taxidermists

• Shipping companies

We are not responsible for:

• Acts or omissions of third parties

• Lost or damaged baggage

• Delayed trophy exports

• Permit issues

• Airline cancellations

All third-party services are subject to their own terms and conditions.

5. Booking, Deposits & Payments

A non-refundable deposit is required to secure safari dates.

Final payment terms will be outlined in your safari agreement.

Failure to remit payment by due dates may result in cancellation without refund.

Prices are subject to change due to:

• Currency fluctuations

• Government fee changes

• Permit adjustments

• Trophy price updates

All trophy fees are subject to final confirmation at the time of harvest.

6. Cancellations & Refund Policy

Deposits are non-refundable.

If a guest cancels:

• Payments may be forfeited

• Rescheduling may be permitted at Company discretion

No refunds will be issued for:

• Unused days

• Early departure

• Missed animals

• Unsuccessful hunts

Travel insurance is strongly recommended.

7. Firearms & Legal Compliance

Guests are solely responsible for:

• Compliance with U.S. export laws

• Compliance with South African firearm regulations

• Proper documentation

• Import/export permits

• Customs declarations

Bombazi Safaris is not responsible for denied permits or confiscation.

Failure to secure required documentation may result in denied participation without refund.

8. Dangerous Game & Trophy Disclaimer

Hunting success is never guaranteed.

Wildlife movement, weather conditions, and environmental factors may affect outcomes.

Trophy measurements are not guaranteed.

All hunting is conducted in accordance with applicable conservation laws and ethical standards.

9. Travel & Medical Responsibility

Guests are responsible for:

• Valid passports

• Required visas

• Vaccinations

• Travel insurance

• Medical insurance

• Emergency evacuation coverage

Bombazi Safaris is not responsible for medical costs incurred during travel.

Guests should disclose any medical conditions that may affect participation.

10. Force Majeure

Bombazi Safaris shall not be liable for delays, cancellations, or failure to perform due to events beyond reasonable control, including but not limited to:

• Natural disasters

• Pandemics

• Government restrictions

• Civil unrest

• Airline disruptions

• Border closures

In such cases, refunds are not guaranteed.

11. Photography & Media Use

Bombazi Safaris may capture photographs and video during safaris.

By participating, you grant Bombazi Safaris a non-exclusive, royalty-free license to use images for marketing purposes unless you provide written notice requesting exclusion.

12. Indemnification

You agree to indemnify and hold harmless Bombazi Safaris from any claims, damages, liabilities, costs, or expenses arising from:

• Your participation

• Your negligence

• Violation of laws

• Misuse of firearms

• Damage to property

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the appropriate courts located in California.

Bombazi Safaris reserves the right to seek legal remedies in any applicable jurisdiction.
